6 Judges’ Letter: SCP asked to take notice under Article 184(3)

ISLAMABAD: Over 300 lawyers [including Imaan Zainab Mazari-Hazir, Zainab Janjua, Abdul Moiz Jaferii, Salman Akram Raja, Taimur Malik and Saqib Jillani (s/o former CJP Tassaduq Hussain Jillani)] on Sunday (31st March, 2024) issued a public statement asking the SCP to take notice of allegations of interference in the judiciary affairs under Constitution’s Article 184(3).

Signatories of the public statement (posted on her X handle by Advocate Imaan Zainab Mazari-Hazir) expressing their ‘unwavering commitment and wholehearted support to the principles of rule of law, independence of judiciary and access to justice,’ held:

“We endorse the resolutions passed by the Islamabad High Court Bar Association, the Islamabad Bar Association, the Sindh High Court Bar Association, the Pakistan Bar Council, the Khyber Pakhtunkhwa Bar Council and the Balochistan Bar Council…

to the extent that they resolve to uphold the principle of independence of judiciary, express solidarity with the six judges of the IHC, commend their courageous action and demand appropriate action to uphold such principles.”

The lawyers, in their public statement, maintained that a commission getting orders/assistance from the executive could not transparently investigate such a grave issue, against the executive itself, with sufficient authority.

It is pertinent to mention here that the Constitution’s Article 184(3) permits the SCP to assume jurisdiction in issues involving a matter of public importance with reference to the enforcement of any of the citoyen’s fundamental rights.
