LAHORE: LHC on Thursday (25th July, 2024) has set aside incarcerated IK’s physical remand in 12 new cases.
According to details a 2-member bench of LHC, comprising Justice Tariq Saleem Sheikh and Justice Anwar-ul-Haq Pannun, has declared the 10-day remand against former PM granted by an ATC in 12 cases related to the 9th May riots.
It may be recalled that new cases surfaced against IK and his wife the very day when they were acquitted in the Iddat (un-Islamic marriage) case and were about to leave the walls of Adiala.
Additional Sessions Judge, (Islamabad-West) Muhammad Afzal Majoka on 13th July, 2024, while accepting the appeals filed by IK and his wife against their incarceration for seven years in Iddat Case, ordered their release if they were not required in any other case.
“Resume of the above discussion is that complainant has failed to prove his case against both the appellants. Accordingly, both the appeals filed by appellants No.1 & 2 are accepted, judgment of learned trial court dated 03.02.2014 is set-aside and consequently both the appellants are acquitted of the charge.
“They are in custody. They are directed to be released forthwith if not required to be detained in any other case. Release robkar be issued in the name of Superintendent Central Jail Adayala, Rawalpindi.
“Record of learned trial court be sent back along with copy of this judgment whereas record of appeals be consigned to record room,” ADJ ordered.
It may further be recalled that on 3rd of Feb, 2024 Islamabad’s Senior Civil Judge Qudratullah had sentenced former PM Imran Khan & Bushra Bibi to seven years incarceration and imposed a fine of five lakh (half million) rupees each in the Iddat case.
The prosecution witnesses (Bushra Bibi’s former husband Khawar Maneka, Aun Chaudhry, Mufti Saeed and Mulazim Latif) were cross examined by Defense Counsels Salman Akram Raja and Usman Riaz Gul.
Imran Khan & Bushra Bibi recorded their statements u/s 342 & responded to prosecution’s 13 questions. The judge, who reserved the decision after conclusion of 14-hour-long hearing on Friday announced the short verdict in the presence of accused in the courtroom located within the premises of Adiala Jail.
After the pronouncement of the verdict, Imran Khan, while talking to Media said though Iddat Case was made to ridicule him, he refused to cut a deal.
It is pertinent to remind the readers that the Iddat Case was filed by Bushra Bibi’s first husband Khawar Maneka. He alleged that Bushra Bibi got married to Imran Khan during the 90-days pause (Iddat) that is mandatory to observe between two marriages.
