ISLAMABAD: Contrary to the prevailing belief, following passage of 26th Amendment Bill, SC’s Justice Muhammad Ali Mazhar maintained on Friday (15th November, 2024) that the Constitutional Bench could take Suo Motu Notice.
While hearing an anti-terrorism case, Justice Mazhar pointed out that the Amendment had changed procedural aspects but it did not eliminate the Supreme Court’s ability to take suo motu notice: “Constitutional Bench is empowered to hear such cases and initiate suo motu proceedings if necessary…
“The procedure may have changed, but the Supreme Court still retains the power to take suo motu notice. The only difference is that such cases are now heard by the Constitutional Bench,” Justice Muhammad Ali Mazhar stated.
