9/May: Military Trial of Civilians Annulled by SCP

ISLAMABAD: A 5-member SCP bench (headed by Justice Ijaz-ul-Ahsan, and comprising Justice Munib Akhtar, Justice Yahya Afridi, Justice Sayyed Mazahar Ali Akbar Naqvi and Justice Ayesha Malik) in a landmark verdict proclaimed Military Trial of Civilians Null and Void.

The short order was read out by Justice Ijaz ul Ahsan. Declaring as null and void the trial of any civilian if already had been carried out by a military court, the bench ordered to conduct the trial of all 102 PTI activists detained in the 9/May case in civilian courts.

The bench, observing that Section 2(1)D of the Army Act is inconsistent with the Constitution, declared its Section 59(4) as void. Justice Yahya Afridi reserved his opinion on declaring the sections of the Army Act unconstitutional.
