MULTAN: Justice Ali Zia Bajwa of LHC has issued a ruling here on Wednesday (17th Dec, 2025) reminding FIA and other agencies that they were required to give reason(s) to the person being offloaded in writing.
After hearing a citizen’s petition vs MoFA etc, Justice Ali Zia Bajwa stated: “Let this court take a moment to remind the FIA and all concerned authorities that every exercise of power that infringes upon the fundamental rights of an individual must find its firm and unambiguous foundation in law.”
Justice Ali Zia Bajwa, noting that petitioner Shaheryar Qandeel had been offloaded despite harbouring all the required documents, directed the FIA to provide him reason(s) in writing as to why he was prevented from travelling abroad, well before next hearing.
He ruled that was a “substantive safeguard to uphold transparency, accountability, and the individual’s right to seek redress…The failure to provide such reasons not only contravenes the principles of natural justice and due process but also constitutes a violation of the constitutionally guaranteed right to freedom of movement.”

Deceased belonged to KP (Bajaur, Kurram, Orakzai and Peshawar). The number of deaths could augment as the boat was carrying 73 illegal immigrants (including 63 Pakistanis and 10 Bangladeshis). It capsized near the port of Marsa Dela, northwest of Zawiya City here on Monday (10th Feb, 2025).
A team, sent by Pakistani Embassy in Tripoli, had assisted the staff of Zawiya Hospital in the identification of the dead. Pakistan’s Ministry of Foreign Affairs had provided contact numbers for inquiries.
Crisis Management Unit has also been activated. Pakistani Embassy in Tripoli actively gathered information about the nationalities of the deceased illegal immigrants. It is pertinent to mention here that this spot happens to be one of the major human smuggling routes on the Mediterranean Sea.
