ISLAMABAD: IHC has suspended on Friday (31st Jan, 2025) the sentences of ten people who had been convicted by an ATC in Nov 2024 and jailed for 5 years and 10 months in connection with the post IK arrest riots.
A division bench of IHC comprising Justice Mohsin Akhtar Kayani and Justice Sardar Ejaz Ishaq Khan, while suspending the sentences, granted bail to them against surety of Rs. 25,000 each.
The ten individuals were incarcerated by the ATC for their alleged involvement in attacking cops and torching a Police checkpoint in Faizabad area of Islamabad. Defense lawyers informed the IHC that the ATC had acquitted the 10 individuals and convicted them on lesser offences.
IHC in its written order maintained that case records did not establish that any of the convicts were nabbed from the protest site of protest: “The accused were not caught from the crime scene, yet they were convicted.” Prosecution asserted that ATC had sentenced them based on forensic and CCTV footage.
It is pertinent of mention here. that five of the ten convicted by ATC are Afghans. Court has ordered the accused to produce the concerned papers to the registrar: In case of Afghanistan citizenship , the registrar shall rtain the documents. In case of Afghan citizenship, the deputy registrar shall retain the documents.”
