ISLAMABAD: During the hearing of an intra-court appeal here on Wednesday (26th Feb, 2025) challenging the trial of civilians in military court, Justice Jamal Khan Mandokhail stated that 5 judges were unanimous in their decision that civilians could not be tried in military courts.
During the proceedings, Advocate Faisal Siddiqui pointed out though there had been 3 separate decisions, members of the 5-member bench were in agreement on the key issue that civilians should not be tried under military jurisdiction. He pointed out that Justices Ayesha Malik, Muneeb Akhtar, and Yahya Afridi had written individual decisions, but all judges agreed on the core observations. Justice Mandokhail happens to be part of a seven-member constitutional bench overseeing the appeal.
