Lawmakers Can Defect In The Parliament

ISLAMABAD: SCP’s 5-member bench led by CJP has unanimously invalidated the Apex Court’s earlier verdict of 2022 (apropos defection clause under Article 63-A of the Constitution), barring lawmakers from defecting in the Parliament, here on Thursday (3rd of October, 2024).

Hearing the pleas of SCBA and others, the Bench approved the review petition that means that parliamentarians can now vote against their party’s directives and policies and their votes would be counted. It may be recalled that a couple of years ago three members of SCP’s 5-member bench (headed by the then CJP Umar Ata Bandial) had proclaimed that votes cast by defecting lawmakers would be reckoned as invalid.
