SCP annuls PHC verdict about SIC reserved seats

SCP

ISLAMABAD: SCP, maintaining that it had to protect the public mandate, annulled PHC verdict about PTI/SIC reserved seats for women and minorities, here on Monday (6th May, 2024).

Hearing the SIC appeal against PHC verdict SCP’s three-member bench – headed by Justice Mansoor Ali Shah and including Justice Muhammad Ali Mazhar and Justice Athar Minallah – noted that it was not written in the law that reserved seats should be distributed among the political parties.

It may be recalled that on 14th March, 2024 PHC bench (led by Justice Ishtiaq Ibrahim and including Justices Ijaz Anwar, S.M. Attique Shah, Shakeel Ahmed and Syed Arshad Ali) had dismissed the petition of SIC challenging the decision of ECP apropos allocation of reserved seats for women and minority.

On 4th of March, PHC held that due to non-curable defects and violation of a mandatory provision of submission of party list for reserved seats which is the requirement of law SIC was not entitled to claim quota for reserved seats.

AGP Mansoor Usman Awan has earlier pointed out since SIC did not contest the General Elections on 8th Feb, it could not be allotted the reserved seats as per the law.

Deprived of its iconic symbol ‘Bat’ PTI candidates fought the elections as independents with a concoction of symbols including dhol and baingun and joined SIC after winning the seats.
