Trump’s Tariffs declared Illegal by SC

WASHINGTON: Supreme Court (SC) of USA in its 6-3 decision of 20th Feb, 2026 has held that Trump had exceeded the limit of his authority as The International Emergency Economic Powers Act (IEEPA), 91 Stat. 1626, does not authorize the President to impose tariffs.

Entities, who had challenged the duties, welcomed the SC’s decision, as it would also translate into refund of billions of dollars. President Donald Trump, terming the ruling terrible, called the justices fools. Undaunted by the SC decision, he imposed a new ten percent tariff in lieu to the ones struck down by the judges. His measure has further bewildered the observers.

It may be recalled that immediately after occupying the White House for the second tenure, President Donald Trump had made it clear that tariffs on imported goods was going to be his major economic as well as external policy. Condemning the ruling as terrible and totally defective Trump held: “I’m ashamed of certain members of the court – absolutely ashamed – for not having the courage to do what’s right for our country.”

Trumpian Tariffs and Mother of all deals

President Donald Trump, while imposing tariffs on countries exporting commodities to USA, expected to revolutionize the American industry and bring jobs back to the United States.

Manufacturers did not launch new units due to augmentation of rates. Lots of them wrapped-up their businesses. Since the exporters did not reduce cost of their wares, the US businesses had to sacrifice thirty percent of their profit margin. The American citoyens were hit by the remaining seventy percent in the form of increased tariffs by importers.

Following a poll conducted recently, it transpired that 54% of voters opposed Trumpian Tariffs. Fifty-one percent noted that Trump’s policies had made life less affordable. Nevertheless, US Govt. happily collected $287 billion in customs duties, taxes and fees in 2025, three times the amount in 2024.  This will enable uncle SAM spend more on defence, social security and debt servicing.
