ISLAMABAD: SCP has restored Adil Khan Bazai, PML-N lawmaker from Quetta on Thursday (12th December, 2024) annulling the ECP verdict of disenfranchising him maintaining that the regulator failed to justify the move.
Three-member bench, headed by Justice Syed Mansoor Ali Shah and also comprising Justices Ayesha Malik and Aqeel Abbasi heard the case. ECP held that according to law an independent candidate could not join a party once he had signed the allegiance affidavit. Whereas, Adil Khan Bazai had sided with PTI/SIC.
Criticising the procedure ECP followed to disqualify Bazai, Justice Ayesha Malik asked what did the commission do to check the facts in his case. Justice Aqeel Abbasi held that the scale of disenfranchising the people of a constituency should be strict: “After getting a letter from baray sahib (greater authority), you de-seat a lawmaker — that is not done!”
